Buying guide

Own it outright.
Here is exactly how.

Botanica's own ownership terms, its published payment schedule, and what the monthly charges actually are. Including the parts agents skip.

Start here

Thailand does not let a foreign individual own land freehold, and Botanica's contract says so in as many words: freehold title is for Thai buyers and Thai companies, foreigners take a registered 30-year lease. That one rule shapes the whole transaction. Read all four structures below before you pick one, and take independent Thai legal advice before you sign — from a lawyer you appointed, not one introduced by the seller.

Leasehold — the route Botanica sells to foreigners

Botanica's own terms are explicit: freehold title is available only to Thai buyers and Thai companies; foreigners and Thai individuals buy leasehold, on a registered 30-year lease. That is the standard structure for every villa in the range, and it is what the sale and purchase agreement will say. Renewal beyond the 30 years is contractual, not automatic under statute — take independent Thai legal advice on that clause specifically, from a lawyer you appointed rather than one introduced by the seller.

Thai limited company — freehold, via a Thai entity

A Thai company can hold the land freehold, and the foreign buyer holds and controls the shares. Legitimate where the company has genuine substance and Thai shareholders who are real; a nominee arrangement is not legal. Structure it with a Thai law firm, not a sales agent.

Freehold — condominium only

The one route where a foreigner takes freehold title in their own name is a condominium unit, up to 49% of a building's saleable area. In the Botanica range that means Hythe by Botanica. Foreign-quota units are finite per building and typically sell first.

Thai spouse or Thai national

Land held freehold in the name of a Thai national. Straightforward on paper, and the route with the most personal risk attached — usually combined with a registered lease or usufruct in the foreign partner's favour.

Bringing the money in

Purchase funds must arrive in Thailand from abroad in foreign currency and be converted to baht locally. Your bank issues a Foreign Exchange Transaction form for each inbound transfer above USD 50,000. Keep every one of them: they are what allows you to repatriate the sale proceeds later, and reconstructing them after the fact is painful.

What we do

We are the sales side, not your lawyer — and we will say so. What we do is get you the correct current documents from the developer, walk you through the specific contract in front of you, and introduce you to independent Thai counsel who has no relationship with the sale.
